These Terms of Use are owner-review placeholder content for QuestKey. They are not legal advice and must be reviewed and completed by the product owner and qualified counsel before publication, app store submission, or use with real customers.
Acceptance
QuestKey is a mobile app and public website for creating, playing, importing, exporting, printing, and optionally sharing treasure hunt experiences. By accessing QuestKey, creating an account, downloading the app, opening a shared hunt, or using related services, you agree to these Terms as completed and approved by FASELA. If you do not agree, do not use QuestKey.
These Terms work together with the Privacy Policy, app store terms, platform rules, and any additional owner-approved terms presented in the app.
Who may use QuestKey
Account eligibility, minimum age, parent/guardian consent, school use, and child-player policies are not finalized in these Terms. Until the product owner supplies reviewed legal decisions, assume that accounts, publishing, and organizer tools are for adults, parents, guardians, educators, or event organizers who can accept responsibility for the hunts they create and manage.
Children may participate in hunts only under appropriate adult supervision. These Terms do not approve child account creation or allow QuestKey to replace parent, guardian, educator, or organizer supervision.
Parent and organizer responsibility
The adult organizer is responsible for designing each hunt, selecting the audience, reviewing all clues and media, deciding whether physical materials are printed or shared, supervising players, and controlling whether a hunt is kept private, exported, imported, or published.
Organizers should avoid including sensitive personal information, unsafe instructions, private addresses, exact child locations, private keys, creator-only notes, or content they do not have rights to use in clues, titles, media, QR codes, PDFs, exports, or public hunt summaries.
Hunt safety and physical locations
QuestKey can support QR progression, puzzle steps, printable cards, and location-based setup choices, but the app cannot inspect or guarantee the safety, accessibility, legality, weather conditions, traffic conditions, or suitability of any physical place. Organizers are responsible for selecting safe and lawful locations, getting any required permissions, checking hazards, planning age-appropriate routes, and supervising players during play.
Do not place clues, QR codes, printed materials, or props where players may trespass, enter restricted areas, interfere with others, cross unsafe routes, damage property, encounter dangerous conditions, or violate venue, school, park, workplace, or local rules.
User content and sharing
You are responsible for hunt content, media, titles, clue text, puzzle details, feature images, printable materials, QR payloads, imports, exports, and any public or shared hunt information you create or distribute through QuestKey.
When you share, publish, export, print, or send a hunt, recipients may copy, save, forward, screenshot, print, import, or modify available materials outside your control. Product owner must confirm the final rules for public catalog listings, takedown requests, moderation, prohibited content, copyright complaints, and whether shared copies can be recalled.
Accounts, cloud features, and service availability
QuestKey may offer local-only app features, account sign-in, cloud storage, hosted media, public catalog browsing, import/export, deep links, and app store distribution depending on the release. Availability, sync behavior, deletion behavior, export behavior, recovery, and support channels must be confirmed by the product owner before final Terms are published.
Services may change, pause, or stop working because of maintenance, device limitations, network conditions, platform outages, third-party provider changes, app store review, account restrictions, or product decisions. Do not rely on QuestKey as the only copy of important hunt materials; keep suitable backups of content you need to preserve.
Acceptable use
You may not use QuestKey to:
- Create, share, publish, or promote unlawful, harmful, deceptive, abusive, harassing, hateful, sexually explicit, exploitative, or unsafe content.
- Encourage trespass, property damage, evasion of venue rules, unsafe travel, dangerous challenges, or unsupervised activities unsuitable for the players involved.
- Collect, expose, or misuse personal information about children, players, organizers, families, schools, venues, or other people.
- Upload or distribute content, images, marks, names, music, text, or other materials you do not have permission to use.
- Interfere with QuestKey, bypass security controls, misuse QR/deep-link/import/export mechanisms, scrape services, or attempt unauthorized access to accounts or cloud data.
Intellectual property and license basics
QuestKey, including its app design, website, product name, software, documentation, visual system, and related materials, is owned by FASELA or its licensors. Subject to these Terms and app store rules, FASELA grants users a limited, non-exclusive, revocable, non-transferable license to use QuestKey for its intended personal, educational, family, event, or organizer purposes.
You keep the rights you already have in hunt content and media you create or provide. You grant FASELA the limited rights needed to operate QuestKey, such as storing, displaying, processing, syncing, publishing, importing, exporting, copying, transmitting, formatting, and backing up that content as necessary to provide the features you choose to use. Product owner and counsel must confirm the final scope of this license.
App stores and third-party services
QuestKey may be distributed through Apple App Store link and Google Play link and may rely on platform services, sign-in providers, cloud hosting, storage, or device features. Your use may also be governed by Apple, Google, Supabase, device manufacturer, network, school, venue, or other third-party terms and privacy policies. Product owner must confirm the final provider list, store-specific language, and any required platform notices.
Disclaimers and limitations
QuestKey is provided as a tool for organizers to create and manage hunts. It does not provide safety, legal, educational, emergency, route-planning, venue-permission, childcare, moderation, or supervision services. Organizers remain responsible for reviewing content, supervising players, and choosing appropriate locations and activities.
Legal counsel must complete any warranty disclaimer, consumer-law savings language, limitation of liability, indemnity, and required regional notices. These Terms must not overclaim enforceability, waive rights that cannot be waived, or conflict with applicable app store, consumer, school, privacy, child-safety, or regional law.
Suspension and termination
FASELA may need to suspend or terminate access to accounts, cloud features, published hunts, support, or future releases if a user violates these Terms, creates risk for others, infringes rights, misuses the service, or if the service changes or ends. Product owner must confirm notice, appeal, data export, deletion, and refund language before publication.
Changes to these Terms
These Terms may change as QuestKey evolves or as legal, platform, product, or provider requirements change. Product owner must define how users will be notified, when changes become effective, and what continued use means after updated Terms are posted.
Disputes
Governing law, dispute resolution, venue, arbitration, class action, small-claims, consumer-law, and school/organization terms are open legal decisions. Until counsel-approved language is finalized, questions or concerns about these Terms should be sent to support@questkey.club.
